British prosecutors are urging a US court to deny a request by influencer Andrew Tate and his brother Tristan that they be released from jail while extradition proceedings play out, ahead of a detention hearing.

They have been held in Florida since their arrest last month after the Crown Prosecution Service (CPS), which prosecutes criminal cases in England and Wales, unveiled 38 charges against them. Both have denied wrongdoing.

The CPS has said the brothers are a “flight-risk”, and would attempt to interfere with the witnesses in the case, according to court filings.

The hearing on Thursday will determine whether the brothers will remain in jail for the duration of their court proceedings.

The brothers, who are dual British-US citizens, were arrested in Miami on 19 July.

They are facing a total of 59 charges, including rape and counts relating to sex trafficking and indecent images of a child.

Both prosecutors and defence lawyers filed new documents on Monday in the Southern District of Florida federal court, ahead of the hearing on Thursday to decide whether they should be freed on bail.

While lawyers for the Tates acknowledged that bail in international extradition proceedings was unusual, they said the brothers had shown no reason to think they plan to evade criminal prosecution. The BBC has contacted the brothers’ attorneys for comment.

Documents filed by the prosecution include a request from the British Embassy in Washington, and sent to the US Department of State, to deny bail.

Supporting documentation from the CPS was also filed highlighting alleged risks if the Tates are released on bond.

“Both Andrew and Tristan Tate have significant resources available to them, both in terms of money and in social media networks,” prosecutors argued.

“All of the complainants in this case are vulnerable and in fear of Andrew and Tristan Tate because of the violence used towards them – several of the complainants describe being assaulted and threatened with weapons – and because of the resources available to Andrew and Tristan Tate, and because of their propensity to intimidate vulnerable complainants.”

Prosecutors also cited social media posts made by Andrew Tate, in which he allegedly mocked prosecutors and suggested he could hide his identity to avoid arrest.

The new charges relate to four new accusers with allegations spanning from 2010-17, according to British prosecutors.

The brothers were already charged in 2025 with rape, bodily harm, human trafficking and controlling prostitution for gain relating to three other accusers in the UK between 2012-15.

Police in Bedfordshire, in south-eastern England, secured European arrest warrants in 2024 for the brothers to have them returned from Romania to face the allegations.

The two moved to Romania in 2016, and were arrested on sex charges in 2022. The case there has not moved forward, and the brothers have been able to travel to the US since travel restrictions against them in Romania were lifted in early 2025.

Self-proclaimed “misogynist” Andrew Tate first rose to fame after an appearance on the British version of reality TV show Big Brother in 2016.

The former kickboxer now boasts more than 10.8 million followers on X. He and his brother have long maintained their controversial statements were just jokes or were taken out of context.

“It is believed that Andrew and Tristan Tate would attempt to draw upon that network to provide practical assistance or financial support to escape the jurisdiction and to avoid extradition proceedings if released,” prosecutors argue.

He has appeared in countless videos, flaunting a luxurious lifestyle of fast cars, private jets and yachts. Prosecutors also pointed to his extensive international travel, as evidence of his ability to avoid trial.

If found guilty, the two could face life in prison.

Although the Tates have supported President Donald Trump, the White House has said it will not intervene in the case.

The decision on whether to extradite the brothers to the UK will ultimately be up to US Secretary of State Marco Rubio, after it is first considered by US courts.
